Promotion Terms and Conditions for [Play to Win: Instagram Filter Game for Standard Chartered Hong Kong Marathon 2024 Souvenir Goodie Bags Giveaway] (the “Campaign”)

The Campaign is organised by Standard Chartered Hong Kong Marathon (the “Organiser”) and is in no way sponsored, endorsed, or administered by, or associated with, any social media platform. By participating in the Campaign, the participant agrees to the following terms and conditions:

1.The Campaign will be held from 9 January 2024 (6:00pm) to 21 January 2024 (11:59pm) (Hong Kong Time) (the “Campaign Period”).

2. Entry eligibility:
To be eligible for the Campaign, participants need to meet the following conditions (“Eligible Participants”):
i) Must be 18 years old or above; and
ii) Follow the instructions in the Campaign post (the “Campaign Post”) on the Facebook / Instagram Page of the Organiser by 21 January 2024 11:59pm (HKT) (“Qualified Submission”):
a. Follow Standard Chartered HK Marathon Facebook ( https://www.facebook.com/hkmarathon ) and Instagram page ( https://www.instagram.com/schkmarathon );
b. Use the Instagram Filter on your mobile : https://www.instagram.com/ar/1064190681702308/ and take a photo with any one of the filters; and
c. Upload it to your Instagram Story with a public account, tag Standard Chartered HK Marathon Instagram page (@schkmarathon) and add hashtag #TogetherWeCheer, and send the screenshot of the Story to Standard Chartered HK Marathon Instagram page (@schkmarathon) to join the Campaign lucky draw. By submitting the Qualified Submission, Eligible Participants accept and agree to be bound by these terms and conditions, and irrevocably authorise the Organiser to use and feature the submitted photos on any website, social media platforms, and other promotional materials for free. Any late submission or any submission that does not comply with the instructions set out in the Campaign Post and these terms and conditions will not be considered as a “Qualified Submission”.

3. Parties associated with this Campaign, including employees of the Organiser, the suppliers and agencies involved in the Campaign, and their immediate families are not eligible for this Campaign.

4. A lucky draw under this Campaign will be held by the Organiser on 26 January 2024, whereby 20 winners (“Campaign Winners”) will be drawn from the pool of Eligible Participants. Each winner will be entitled to one set of Standard Chartered Hong Kong Marathon 2024 souvenir goodie bags (the “Campaign Prize”) after answering a question about the Standard Chartered Hong Kong Marathon 2024 correctly.

5. Each Instagram User can only participate in the Campaign once and will be entitled to one lucky draw chance regardless of the number of Qualified Submissions he/she enters during the Campaign Period.

6. The lucky draw results will be announced under the comment section in the Campaign Post on the Organiser’s Facebook and Instagram Fan Page on 29 January 2024. Campaign Winners must send a private Instagram message to the Organiser on or before 5 February 2024 11:59pm (Hong Kong Time) in accordance with the instructions in the comment (the “Winner’s Reply”). Upon receipt of the Winner’s Reply, the Organiser will provide the Campaign Prize collection arrangement to the Campaign Winners through Instagram message.

7. If the Campaign Winner fails to send the Winner’s Reply to the Organiser or the Organiser has not received the Winner’s Reply on or before 5 February 2024 11:59pm (Hong Kong Time), the Campaign Winner will be disqualified and the Campaign Prize will be forfeited without prior notice, and the Organiser accepts no liability and will not be liable for any compensation. The Organiser shall have the right to award the Campaign Prize to an alternate backup Campaign Winner at its sole discretion.

8. Campaign Winners will receive prize collection instructions after sending the Winner’s Reply to the Organiser. Please contact the Organiser on or before 9 February 2024 to arrange prize collection. Failure to do so will result in automatic cancellation in the eligibility to win the Campaign Prize without prior notice, and the Organiser accepts no liability and will not be liable for any compensation. The Organiser shall have the right to award the Campaign Prize to an alternate backup Campaign Winner at its sole discretion.

9. All Campaign Prizes are non-exchangeable, not returnable and cannot be redeemed for cash. The Organiser reserves the right to replace the Campaign Prize with any alternative gift / offer without prior notice.

10. Lost Campaign Prize will not be re-issued or replaced; lost or delayed posts on the Organiser’s Facebook and Instagram Fan Pages will not be entertained, and the Organiser accepts no liability and will not be liable for any compensation.

11. Campaign Winners understand and accept that the Organiser is not the supplier of the Campaign Prize offered in this Campaign. The Organiser shall bear no liability relating to any aspect of the Campaign Prize, including without limitation, its quality and the supply, the descriptions of the Campaign Prize provided by the supplier(s), any false trade description, misrepresentation, mis-statement, omission, unauthorised representation, unfair trade practices or conduct in connection with the Campaign Prize provided by the supplier(s), their respective employees, officers or agents. Redemption of the Campaign Prize may be subject to additional terms and conditions as stipulated by the supplier(s).

12. If the Campaign Prize includes food or beverages, Campaign Winners shall take note of the potential risks of suffering from allergies upon intaking some kind of foods or beverages. The Organiser shall not be liable for any losses and / or claims and / or damages caused due to food and beverage allergy;

13. The Organiser, any of its officers, employees, agents, and affiliates is not liable for any direct or indirect claims, demands, proceedings, actions and expenses (including legal fees) arising from or in connection with the Campaign, including but not limited to:
a. any personal injury, loss, or damage sustained during or as a result of your participation in the Campaign or the receipt or use of the Campaign Prize.
b. any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, theft, destruction, unauthorised access to, or alteration of, submissions or any other materials.
c. any printing or typographical errors in any materials associated with the Campaign.
d. any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, or any other intellectual property-related rights.

14. The Organiser reserves the right to forfeit the eligibility of participants who submit, post or leave any comment, the content of which is, in the opinion of the Organiser, inappropriate or otherwise relating to sex or violence or the language of which may lead to libel, defamation, obscenity, abuse, incitement or intimidation. The Organiser shall have the right to delete any such contents from the Organiser’s Facebook and Instagram Fan Pages anytime at its sole discretion. The Organiser reserves all rights against those participants who have committed actions as mentioned in this Clause.

15. The Organiser reserves the right to vary, modify and terminate the Campaign and to amend any of these terms and conditions at any time without any notice. In case of dispute, the decision of the Organiser shall be final and binding.

16. If there is any inconsistency or conflict between the English and Chinese versions of these terms and conditions, the English version shall prevail.

17. This Campaign and its terms and conditions shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising out of or in connection with the Campaign shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
